"Invasion" of public land on Viale Africa: platforms and canopies of a venue seized

The Preliminary Investigating Judge of the Court of Catania, accepting the request of the District Attorney's Office, has ordered the preventive seizure of a structure built on public land in an area designated for public green space along Viale Africa, in Catania.

The measure was issued at a stage when the adversarial process with the defenses has not yet taken place and the presumption of innocence of the accused remains intact.

The act originates from the results of a control carried out in a food and beverage establishment linked to a 63-year-old resident of the city.

The investigations revealed an unauthorized expansion of about 20 square meters, carried out through a wooden platform anchored to steel elements, with support framing and sheet metal roofing.

Additionally, the expansion was connected to two canopies of about 12 meters each, supported by metal tubular posts and equipped with telescopic awning covers, for a total area of 74 square meters.

Considering the nature of the alleged offense and the location of the work on public land, the GIP deemed the conditions for the adoption of the real precautionary measure of preventive seizure to be met, aimed at preventing the continuation or worsening of the consequences of the crime.

The measure was executed by the Carabinieri of the Piazza Dante Company, with the support of the Local Police.

The structure has been entrusted to the owner under judicial custody.
